Welcome to Binde, a card collection tracking and social community App operated by Binde LLC. By creating an account or using Binde, you agree to these Terms of Service. Please read them carefully before using the App.
By accessing or using Binde, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use Binde. These Terms apply to all users, including users who are minors aged 13 to 17.
Capitalized terms used throughout these Terms have the following meanings:
The App is strictly prohibited to individuals under thirteen (13) years of age. If you are between the ages of 13 and 17 (a "Minor User"), you represent and warrant that you have reviewed these Terms with your parent or legal guardian, and that your parent or guardian has consented to your use of the App, including all peer-to-peer messaging and portfolio-tracking features.
Parents and guardians are entirely responsible for the actions, monitoring, and any subscription purchases made by their Minor Users on the App. We reserve the right to immediately terminate any account if we learn that a user is under 13, or using the App without required parental consent.
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
You may only maintain one account. Creating multiple accounts to evade a suspension or ban is prohibited.
Binde is a community for card collectors. You agree to use Binde only for lawful purposes and in accordance with these Terms and our Community Guidelines.
You agree not to:
You retain ownership of all User Content you create, upload, post, or send through the App, including posts, comments, card photos, text, messages, and portfolio information.
You represent and warrant that you own or have the necessary rights to any content you upload, and that your content does not infringe the intellectual property or other rights of any third party.
We reserve the right to remove any content that violates these Terms or our Community Guidelines, without notice.
By posting or sending User Content through the App, you grant us a worldwide, royalty-free, perpetual, and irrevocable license to host, store, display, reproduce, and modify that content solely to operate and improve the App.
No Liability for Inter-User Communication. We do not pre-screen, verify, or endorse User Content. All communication occurs strictly between Users. We are not responsible or legally liable for the conduct, safety, behavior, accuracy, or content of any messages sent by Users, nor are we liable for any external trades, sales, or physical transactions arranged through the App. You interact with other Users entirely at your own risk.
We have no obligation to monitor messages, but we reserve the absolute right to use automated safety filters and human moderation to review, flag, or delete User Content at any time without notice.
The App features active "Block" and "Report" tools. If you are reported or found violating these Terms or our Community Guidelines, we reserve the right to immediately and permanently ban your account and block your device access without warning. If your account is banned for a safety or conduct violation, you forfeit all remaining time on any paid premium tiers and no refunds will be issued.
Binde provides in-App tools to report posts, comments, and messages that violate these Terms. Reports are reviewed by a human member of our team — not solely by automated or AI systems — and we may take action including content removal, account suspension, or permanent termination. We are not obligated to take any particular action in response to a report.
You may block another user by visiting that user's profile and selecting "Block" — blocking is initiated from the profile of the user you wish to block, not your own. Blocking removes the follow relationship between you and hides that user's content from your feed. Blocking does not restrict the blocked user's own access to their own profile or Account.
Card names, images, and related data displayed in Binde are the property of their respective owners, including card game publishers, sports leagues, and other rights holders. Binde LLC is an independent tool and is not affiliated with, endorsed by, or sponsored by any card game publisher, sports organization, or rights holder.
The Binde name, logo, and App design are the intellectual property of Binde LLC. You may not use them without our prior written permission.
Any card prices or estimated values shown in Binde are sourced from third-party pricing data and are provided for informational purposes only. They are not guaranteed to be accurate, current, or reflective of actual market values. Binde LLC is not responsible for any financial decisions made based on these values.
No Appraisal or Investment Advice. The App is a software tool intended solely for informational and entertainment purposes. No information, metric, or valuation displayed by the App constitutes financial, investment, tax, legal, or formal appraisal advice.
Complete Waiver of Financial Liability. You assume 100% of the risk for any transactions you make outside of the App. We are not responsible or legally liable for any financial losses, bad trades, missed profits, or incorrect purchase or sale decisions you make based on third-party pricing data provided through the App.
Binde offers features that allow users to mark cards as available for trade or sale, discover nearby collectors, and arrange in-person meetups. These features are designed to foster local, in-person collector communities — not to function as an online marketplace or e-commerce platform. The following terms apply to these features.
Binde is not a marketplace. Binde does not facilitate payments, hold funds, take a commission, or act as a party to any transaction between users. All trades and sales are private arrangements made entirely between the users involved. Binde's role is limited to helping collectors discover each other and connect — Binde is built around local, community-based collecting, not online commerce.
Local radius requirement. Trading and selling features are limited to collectors within approximately 250 miles of each other. This applies to all users, including collectors who follow each other. This is a deliberate design choice: Binde's trading and selling features exist to help you connect with other collectors in your area and arrange in-person exchanges, not to operate as a shipping-based marketplace or facilitate remote commerce. You will not be able to discover, message about, or arrange a trade or sale with a user outside this radius through these features.
Public profile and Discover. Trading and selling listings are surfaced to other collectors through the Discover feed, which only shows Public profiles — if your profile is set to Private, your listings will not appear in Discover and other collectors will not be able to find you through it. This does not prevent you from trading or selling with collectors you already follow or who follow you: mutual connections can still view each other's listings and arrange trades or sales regardless of privacy setting. You can change your profile visibility at any time in Settings.
Location services required. Trading and selling features require location services to be enabled, for all users and regardless of follow status, in addition to and separately from the Discover feed. Binde uses your approximate location solely to enforce the radius requirement described above and to show you nearby collectors; see our Privacy Policy for details on how location data is collected and used. If location services are disabled, trading and selling features will not be available to you.
No guarantee of transactions. Binde makes no representations or warranties regarding the accuracy of any listing, the condition or authenticity of any card, or the reliability of any user. All trades and sales are conducted entirely at your own risk. Binde LLC is not responsible for any loss, damage, fraud, dispute, or dissatisfaction arising from a transaction arranged through the platform.
Safe Swap (definition). "Safe Swap" refers to Binde's general guidance and practices for completing in-person trades and sales safely — including meeting at a Safe Spot (as defined below), bringing a friend when possible, and exercising reasonable caution when meeting another user for the first time. "Safe Swap" is a set of recommended practices, not a distinct verification, escrow, or insurance feature, and Binde does not supervise, mediate, or guarantee the outcome of any trade or sale conducted under this guidance.
Safe Spot (definition). A "Safe Spot" means a public, well-lit, populated location appropriate for meeting an unfamiliar person to complete an in-person trade or sale — for example, a retail store, café, or similar public business during normal operating hours, rather than a private residence, vehicle, or secluded or poorly-lit area. Binde does not currently designate, list, or verify specific Safe Spot locations or businesses within the App. This definition is provided solely as guidance for users arranging their own meetups, and Binde LLC makes no representation regarding the safety, security, or suitability of any location a user chooses to use as a Safe Spot, and is not liable for any incident, injury, loss, theft, or harm that occurs at or in connection with any such location.
Users under 18. Users between the ages of 13 and 17 may not list cards as available for trade or sale without verifiable parental or guardian consent. By permitting a minor to use Binde, the parent or guardian accepts full responsibility for any transactions the minor initiates or participates in through the platform.
Your responsibility. By using the trading, Discover, and Safe Swap features, you agree that you are solely responsible for any transaction you enter into, any meetup you arrange, and your personal safety when meeting another user in person. Binde strongly recommends meeting only at a Safe Spot (as defined above) during normal business hours, and never alone.
Your use of Binde is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may suspend or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms, our Community Guidelines, or for any other reason at our sole discretion. You may delete your account at any time from within the App.
Upon termination, your right to use Binde ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, and limitation of liability.
Binde is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that your data will never be lost. We strongly recommend maintaining your own records of your collection.
To the maximum extent permitted by applicable law, Binde LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or related to your use of Binde.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of Binde must first be attempted to be resolved informally by contacting us at the email below — you agree not to initiate arbitration until you have made this attempt. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, seated in the State of North Carolina, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Your continued use of Binde after changes are posted constitutes your acceptance of the revised Terms.
